Terms of Service

By commissioning me you confirm you understand and agree with these terms and conditions.

TerminologyYou are the commissioner/client/buyer.
I am Nicst/Nixtetic, the artist.
Artwork/product/work/piece is the artwork commissioned.
"Personal use" in regards to commissioned artwork is displaying the commissioned artwork online, printing it, and is non-profitable.
Artwork terms• Sketch: preliminary drawing/draft to decide on desired illustration look. This includes thumbnail sketches which are quick drawings usually done rapidly with no corrections.• Work-in-progress: (WIP) in this context is a partially finished illustration awaiting completion and provided to the client as progress updates and is typically part of the sketch stage.• Line art: Line art or line drawing is any image that consists of distinct straight or curved lines placed against a (usually plain) background.• Coloring: Application of color themes/palettes, atmosphere, and mood of a piece.• Shading: The use of marking made within outlines to suggest three-dimensionality, shadow, or degrees of light and dark in a picture which is part of the coloring stage.• WIP: A work-in-progress (WIP) in this context is a partially finished illustration awaiting completion and provided to the client as progress updates.


1. GENERAL TERMS• The artist is willing to change/make exceptions to the terms when discussed and coming to an agreement.• All artworks will include a signature or logo that the client may not remove.• The artist may record the artwork process and post it on social media.• Reposting commissioned artwork is allowed if proper crediting is given including linking any of the artist's relevant social media account/s.• The artist reserves the right to reject any order.• The artist is providing services for personal use.
* I.e., displaying the commissioned artwork online in non-paid spaces, printing it, and is non-profitable unless agreed upon a commercial contract. Extra charges or royalties will apply for commercial projects.
• The client will receive only a full-resolution digital file of the commission. No physical item will be shipped to the client's home address.• The artist may record the artwork process and post it on social media.• Prices are subject to change based on demand & complexity.• Cryptocurrency will not be accepted as a form of payment.• The sketch updates or the finished illustrations provided are prohibited to be minted or sold as NFT (non-fungible token.)


2. PAYMENT
• Payments are done in American dollars (USD) 100% upfront, through a Paypal invoice.
• 50:50 split payment can be discussed if the total commission cost exceeds 600 USD.• The commission will not be started until the payment is processed.• The payment must be completed within 48 hours of the client receiving the invoice.• Cryptocurrency will not be accepted as a form of payment.


3. COMMISSION PROCESS AND DELIVERY•  The client will be notified when the commission is started by e-mail or social media.• While the artist works on your commission, the client will receive progress update reviews. The amount of reviews depends on the complexity of the work.• During the reviews, the client will see work-in-progress and these images will usually include a watermark.• The time it takes to finish the client's commission varies from 1 week - 1 month depending on factors such as health, the complexity of the commissioned piece, and other work reasons.• If anything comes up that will slow the progress of the initially estimated delivery time, the client will be informed ASAP.• Once the piece is finished, the client will receive the full-resolution image along with a web-friendly size by e-mail or social media.


4. REVISIONS• The client is limited to 3 edits during the sketching stage, and 1 chance for minor adjustments in the finishing stages (including hues, painting in missing details, text variations). No major changes are allowed in the finishing stage that will affect the overall composition of the piece.• If the client wishes to make a change once the product has been completed, there will be a revision fee - unless a misunderstanding from the artist's side has been made.• If the client wishes to change something in the artwork they had pre-approved, the artist will charge the client a fee to change it. The amount of the extra charge depends on the change the client desires and is usually based on an hourly wage.• If the visual references provided are insufficient or ambiguous, changes will come at an extra charge, as it would count as design work, thus raising the cost.


**5. COPYRIGHT / USAGE POLICY
** __ I, Nicst/Nixtetic (the artist), claim the rights to the produced illustration. Therefore I am allowed to use the copyrighted artwork. This includes, but is not limited to: __
• Posting/distributing my artwork on galleries, portfolios, self-promotion printing on art books, or price samples.• Display the artwork on social media (websites, social media, etc.)The client is allowed to:
• Use the commissioned piece for personal use unless agreed otherwise (you can upload it on all your social media profiles, forums, etc.)
• Print the artwork and claim the original character(s) as their own, but not the artwork itself.• Use the artwork to promote themselves.• Use the artwork on their social media and in monetized videos as long as the artwork itself is not the main subject for the earnings (ie. a mascot, merchandise, or logo).

The following is considered copyright infringement:• Reproducing/using the copyrighted artwork commercially - means making money off it in any way.• Claiming the artwork as your own• Removing the artist's signature from the artwork without permission• Altering the artwork without the artist's consent• The artist reserves the full rights to the image and its use/distribution unless otherwise agreed upon (rights to the image for the client's non-personal use may be purchased at any time if discussed).


REFUND / CANCELLATION POLICY• If the client cancels the order before the sketching stage has been started by the artist, the client will receive a full refund.• If for any reason the artist is unable to start the client's commission, the client will receive a full refund.• The client is not permitted a full refund once the artist starts working on the commission.• If the sketch stage hasn't been approved by the client, the client is only eligible for a 50% refund.• The client is ineligible for refunds once the sketch has been approved by the client.• If the client wishes to get a refund, please contact the artist by e-mail at [email protected] or on social media to discuss.

By buying this adoptable from me you confirm you understand and agree with these terms and conditions.

Terminology
You are the client/buyer.
I am Nicst/Nixtetic, the artist.
Artwork/adopt/character/design is the character purchased.

You must reply to my comment “BID HERE”. Please bid in the chain to allow the previous bidders to keep track of the bids. I accept private offers and will add your offer in the replies on your behalf.SB: (Starting Bid) is the minimum price of the adopt and will be mentioned in the description. You may reply with "SB" or "Starting Bid" in the comments to begin bidding.
AB: (Auto Buy) is the set price that will immediately end the auction and the buyer will own the adopt without having to wait for other bids. In this case, reply with “AB” or “Auto buy”.
MI: (Minimum Increase) the minimum amount needed to add to a previous bid to beat it.
Snipe Guard: as the auction reaches its end at the last minute, new bids will extend the bidding time by 6 hours. The final bid must not be contested within those 6 hours for the auction to end.SB: 300 USD
MI: 10 USD
AB: None


Payment:

  • Having the funds on hand is a must.

  • Only accepted currency is American USD, completed through a PayPal invoice and 100% upfront.

  • Payment must be received within 48 hours or the adopt will be put up for sale again.

  • Cryptocurrency will not be accepted as a form of payment.


After purchase - What you will receive:

  • You will receive the unwatermarked full-resolution digital file version of the adopt, flats and palette. If bid is 500$+, you will receive the adopt’s back reference as well (flats & rendered). Transparent images are available upon request.

The artist may:

  • Post/distribute the artwork on galleries, portfolios, self-promotion printing in art books, or price samples.

  • Display the artwork on social media (websites, social media, etc.)

The buyer may:

  • Give the adopt a different name, personality, gender, story… treat it like your own character!

  • Use the character for a story, as an avatar on social media (or online games), as a signature, forums, or RP. This character is for your personal use.

  • The edits must not go as far as to cause the original design to be unrecognizable. You may add additional outfits, add accessories, and change the colors of the character. If the original file is edited, please inform me.

  • Use and feature the character in comics or stories that are non-profit.

  • Sell prints of your own artwork featuring the character, but you must give credit to me as character creator.

  • If you trade, sell, or gift the adopt, please inform me to keep track of ownership.

  • Important! You may resell the adopt for the same price you bought it for, no more. If you have commissioned additional artwork from other artists, you may increase the price but only if the artist has given you permission to do so with proof of purchase provided to me. You must let the new owner know of the adopt TOS.

  • Cannot resell an adopt you received as a gift; you can only give it as a gift to someone else.

  • Ask help to feature your forum/journal etc. indicating the resell/trading of your adopt.

The buyer may not:

  • Claim the original art or original design as theirs.

  • Use the original artwork and design for commercial use without permission.

  • Claim a refund, as the auction is final sale and non-refundable.

  • Edit their bid comment or drop it from the previous offer, if it is dropped more than once, they (the buyer) will be blacklisted from the auction.

  • Sell or trade the adopt once it has been gifted.

  • Use the character & original artwork in large-scale projects commercially (for profit) such as official comics, games, or publishing. Please contact me to discuss a contract as additional rights must be purchased for the design (royalties, etc).

  • The character and artwork are prohibited to be minted or sold as NFT (non-fungible token). This will immediately violate terms and will cancel ownership of the design and the artist is permitted to re-sell the character.
